TRANSACTION SPOTLIGHT
After the NJ Supreme Court’s Mount Laurel IV decision, we counseled our clients to intervene in subsequent municipal Declaratory Judgment actions. One such municipality is located in eastern Morris County. The site consists of 73 acres and represented a unique “blank slate” opportunity for planned development. After patience and cajoling,
this municipality met with us to explore possibilities for
this valuable site. The municipality was understandably concerned about public reaction to large-scale development. But, they also realized the positive potential for this site.
We asked the town about their needs and how we could work collaboratively to produce a world-class project.
After several mediation sessions, we reached agreement
for a mixed-use town center Redevelopment project with state-of-the-art design and architectural features to provide housing and a variety of other uses. The result is the largest inclusionary project in Morris County, consisting of: 1,500 units of housing with 15% affordable housing; 10% PILOT for the residential component of the project; 80,000 square feet of commercial town center development; two hotels; 28,000 square feet of office; 32 supportive housing beds; and public spaces for passive recreation, including a 7,200-square-foot public trail.
 We represent developers and property owners in suburban and urban areas. Our clients engage in a variety of uses, including multifamily, industrial, mixed use, golf, retail, office, hotels, automobile dealerships, industrial, self- storage and schools. The Firm also serves as redevelopment counsel and board attorneys for governmental entities.
ON THE HORIZON
In suburban New Jersey, the affordable housing process continues creating opportunities for high-end inclusionary developments. We believe that communities will recognize the benefits of these developments, particularly where developers tailor their projects to meet the unique needs of their communities. Creating live/work environments, redeveloping downtowns and addressing community needs are a few concepts that can propel projects’ success. We believe there will be increased utilization of the Redevelopment Law, and its financial tools.
In urban New Jersey, we see high demand for market- rate housing. Young professionals and empty-nesters want urban environments with walkable amenities such as transportation, restaurants and entertainment. The private sector is responding with prodigious investment to create world-class urban communities. We believe this transformative development has only just begun.
