Our attorneys have significant experience in representing developers before governmental agencies in the development and redevelopment process, and we regularly assist our clients in structuring innovative financing arrangements to make redevelopment possible, including through the use of tax credit incentives, an area of expertise in which we are a leader.
TRANSACTION SPOTLIGHT
2024 / 2025 continues to be very active for complex and transformational projects throughout the state. We’re proud to have contributed to two projects, in particular, that have made headlines in both Newark and New Brunswick, respectively. The New Jersey Performing Arts Center campus redevelopment — a 6.1-acre neighborhood including residential, retail, arts and culture, entertainment and public space — closed under our guidance in December 2024. This is a highly complex multiparty land transaction, including multiple joint ventures, construction financing and Aspire tax credit sale. In New Brunswick, the HELIX project is dominating the skyline and headlines. The project includes numerous redevelopment issues — land acquisition, tax credits, redevelopment agreements, bond financing, public-private partnerships, private joint ventures, collaboration with multiple major educational, health care and academic institutions, environmental remediation and others. Complexity, creativity and innovation are distinguishing characteristics of our work, and we’re proud to have a hand in these projects and so many more.
CREATIVE SOLUTION
The creative integration of New Jersey Economic Development Authority tax credits into significant redevelopment projects has been a major component of our recent representations. While the law will accommodate complex ownership and capital structures, working with clients to accomplish their business objectives while meeting the legal requirements of the programs has necessitated the development of sophisticated legal and financial solutions. We expect to remain at the forefront of legal representation for clients applying for Aspire tax credits while also utilizing our expertise on projects under the NJEDA’s new CAFE (Cultural Arts and Facilities Expansion) program.
