PROJECT SPOTLIGHT
We recently assisted an investor with the acquisition of 88 properties. The seller acquired the properties by way of Deed In Lieu. This acquisition was financed by five separate loans. The properties were deeded to a number of different entities, resulting in multiple sellers on the transaction. Each property contained different liens and tax sale certificates. The title commitment for each loan had to be very specific and detail the clouds on title for each property. We obtained numerous payoff s for tax sale certificates and duplicate certificates of redemption to clear liens. Additionally, we coordinated with all parties to close the properties on the same day, and handled the collection and disbursement of all funds, the recording of 88 deeds, 5 mortgages, 5 assignments of leases and rents and tax sale cancellations.
On another transaction we worked with the lender’s attorney and underwriting counsel to resolve an error in the survey and metes and bounds description of a 6.3- acre indoor sports complex. The solution we proposed allowed us to satisfy the lender’s requirements, insure the transaction without exception for the error and saved our client from having to obtain a new survey at significant cost.
